Terms and Conditions
The Claim and the Guarantee: At Upstart Mortgage, LLC (“Upstart Mortgage,” “we, “us,” “our”), NMLS No. 2443873, 2950 S. Delaware Street Suite 400, San Mateo, CA 94403, we believe our Home Equity Line of Credit (“HELOC”) rates are lower than any other duly licensed lender. If you prove us wrong, we will give you a $200 Amazon Digital Gift Card. This HELOC Rate Guarantee (the “Rate Guarantee”) is solely sponsored by Upstart Mortgage and is in no way affiliated with Upstart Network, Inc. or any other lender, nor is it sponsored or endorsed by Amazon. See below for important details about the Rate Guarantee. By providing information to Upstart Mortgage in connection with this Rate Guarantee, you agree to abide by these Terms and Conditions. This Rate Guarantee is void or limited where prohibited or restricted by federal, state, or local law.
Rate Guarantee Eligibility: To be a part of the Rate Guarantee program, beginning December 10, 2025, you must apply and be fully approved (no credit conditions or contingencies) by Upstart Mortgage for a HELOC on your primary residence (the “Subject Property”).
If within 45 calendar days of receiving an approval from Upstart Mortgage, you receive a Lower Comparable Offer (defined below), then we will pay you $200. In order to be considered a valid Lower Comparable Offer, you must receive a fully underwritten approval (no credit conditions or contingencies) from a duly licensed mortgage lender, other than Upstart Mortgage, with an interest rate, before any discounts, promotions, or adjustments, that is lower than ours; and, as compared to our approval, the Lower Comparable Offer must be for (i) the same Subject Property, (ii) payment terms greater than or equal to ours, (iii) loan amount (credit limit) greater than or equal to ours, and (iv) same lien position.
This Rate Guarantee program excludes discounted, introductory, temporary, or promotional interest rates and offers.
How to Redeem: To redeem, please email [email protected] to request an evaluation of your Lower Comparable Offer. We will provide instructions on how to submit your Lower Comparable Offer in our response back to you. You must submit your request for an evaluation within (i) 10 business days after you are approved by us or (ii) 10 business days after you are approved by another lender, whichever occurs last. Notwithstanding anything contained in these Terms and Conditions to the contrary, in no event will a Lower Comparable Offer be considered or eligible for this Rate Guarantee if the Lower Comparable Offer approval date is dated outside of the 45-day period or we do not receive your request for the Lower Comparable Offer evaluation within the 10 business day window mentioned above. Once we provide you instructions to submit a copy of your Lower Comparable Offer to us, you have five (5) business days to do so. Failure to meet this timeline will vacate your request and no further action will be taken with respect to this Rate Guarantee. This decision is final and in our sole discretion. A Lower Comparable Offer must include documentation clearly showing the underwriting approval terms and the interest rate before any discounts, promotions, or adjustments. Screenshots, advertisements, pre-qualification letters, or incomplete approval materials will not be accepted.
Once we receive a copy of your Lower Comparable Offer, Upstart Mortgage may, in its sole discretion, use whatever methods it chooses (in no case will such methods be more restrictive than that which was used to fully approve your Upstart Mortgage HELOC) to determine the validity of the Lower Comparable Offer, and Upstart Mortgage’s determination will be final. If, within five (5) business days after Upstart Mortgage’s request, you fail to provide satisfactory additional evidence related to your Lower Comparable Offer, you will be disqualified from the Rate Guarantee. Upstart Mortgage will determine in its sole discretion whether the terms of your Lower Comparable Offer are comparable to HELOCs we offer.
Persons associated or affiliated with or employed by Upstart Mortgage or its affiliates, subsidiaries, parent companies, or advertising partners, and the immediate families and/or household members of each, are not eligible.
If you accept and close on a HELOC from Upstart Mortgage, additional terms and conditions may apply as it relates to your HELOC account. Please refer to your HELOC Agreement and closing package (collectively, the “HELOC Account Documentation”). Subject to requirements set out in these Terms and Conditions, you may still be eligible to participate in the Rate Guarantee even if you close on a HELOC from Upstart Mortgage. In the event of an express conflict between the HELOC Account Documentation and these Terms and Conditions, with respect to matters relating to the HELOC Rate Guarantee, these Terms and Conditions will apply.
The Payment: Limit one $200 Amazon Digital Gift Card (the “Digital Gift Card”) per subject property address, regardless of the number of fully underwritten conditional approvals you submit or the number of applicants who apply. If the validity of the Lower Comparable Offer is confirmed, the Digital Gift Card will be sent to the email address we have on file for you. If you do not receive your Digital Gift Card in a reasonable timeframe, please contact us. Our notice information is at the bottom of these Terms and Conditions. Accepting the $200 Digital Gift Card may have tax consequences, so please consult your tax advisor.
Fraud or Misuse of the Rate Guarantee: To the fullest extent of the law, we reserve the right to cancel your participation in this Rate Guarantee, without notice, in the event you violate these Terms and Conditions, you violation of our Website Terms of Use, or in the event of fraud, gaming, abuse, or misuse of the Rate Guarantee or any patterns suggestive thereof. For the avoidance of doubt, if we determine in our sole discretion that you are attempting or have attempted to misuse the Rate Guarantee, neither you nor anyone submitting a Lower Comparable Offer on behalf of the Subject Property Address will be eligible to earn the Digital Gift Card, and we may reverse or cancel any Digital Gift Card accrued or previously sent resulting from the fraud or misuse.
Changes or Termination of the Rate Guarantee: We may change, suspend, or terminate the Rate Guarantee or your participation therein at any time without notice or limitation, and in our sole discretion. Such changes might affect your ability to earn the Digital Gift Card. We will give you notice to the extent required by law.
Limitation of Liability: Unless otherwise required by law, we will not be liable to you or anyone making a claim on your behalf or on behalf of the Subject Property, in connection with: (1) any change or termination of the Rate Guarantee; (2) any loss, damage, expense or inconvenience caused by any occurrence outside of our control; (3) any taxes that you incur as a result of receiving rewards, payment of which taxes will be your responsibility; (4) any merchandise or services you purchase, or for any direct, indirect or consequential damages related to our services. In any event, the aggregate amount of any liability that Upstart Mortgage may have to you in connection with the Rate Guarantee shall be limited to $200.
Dispute Resolution: Contact Us First. If you have an issue with this Rate Guarantee, or if a dispute arises between you and us, please contact us first. Our goal is to learn about and address your concerns to your satisfaction; and if we are unable to do so, then to provide you with a neutral and cost-effective means of resolving the dispute quickly.
